Professional Negligence
Professional negligence is a breach of the duty of care between you and your customers. The duty of care is a common law arrangement where your customer expects a level of professionalism and standards commonly held by those in your profession.
When you are instructed in a professional capacity, you are likely to owe not only a contractual obligation to your customer but also a duty of care. If you breach that duty of care, resulting in your customer suffering reasonably foreseeable loss then you may have been negligent.
If you are found to have been negligent, the court may award damages against you in order to compensate the person who has suffered as a result.
We can help with special pre-action protocols that apply to professional negligence issues, and it is important that these pre-action requirements are met, and that genuine steps are taken to resolve matters at an early stage. We can help with negotiation and alternative dispute resolution such as mediation.
So, if you are a professional person and someone has alleged that you have been negligent in providing your professional services, or you consider that you have suffered losses as a result of a professional person’s negligence, we can help.
